Development Variance Permit 96 - 1250 Judd Road

The District of Squamish has  initiated a development variance permit application on property described as:

Lot 2 Fractional South ½ of North East ¼ of Section 15 TP 50 Plan EPP47372

Located at 1250 Judd Road in Squamish, B.C.

This application, if approved would enable an accessory building to be located adjacent to the rear lot line. The existing zoning regulations require an accessory building to be located not less than 1.52 m from the rear lot line. The application was initiated by the District of Squamish to facilitate the process of accepting a community amenity contribution.

Background

On February 3rd, 2015 Council adopted “District of Squamish Zoning Bylaw No. 2200, 2011, Amendment Bylaw (Comprehensive Development Zone No. 81 - 1250 Judd Road) No. 2345, 2014”. One of the conditions of adoption of this bylaw was the dedication of a portion of the subject property containing the Squamish River dike to the District of Squamish. This subject has been fulfilled; however, subdivision of the dike from the parent lot involved the creation of a lot which did not meet District zoning regulations. An accessory building located on Lot 2 (the subject of DVP 96) does not meet the rear setback requirement of the CD-81 zone due to its proximity to the rear lot line. Prior to approval of the subdivision application, District of Squamish staff initiated DVP 96 to resolve the non-conformance issue related to the accessory building.
